Adoptions

Adopting a child is a life changing event - a fulfilling moment in a parent’s life. You cannot afford, emotionally or financially, to take any chance of facing major problems years from now due to potential problems not being recognized and dealt with from the start.  Make sure your attorney has experience with any issues that may arise, especially with minor birth parents, relinquishing or terminating parental rights, or issues arising under the Interstate Compact on Adoption.  Mr. Roberts has extensive experience handling interstate, intrastate, international, related, step-parent, closed or open adoptions, and will work with your adoption agency or directly with birth parents.  Let Mr. Roberts assist you in building your new family.

Handling Estates After Death

When a loved one dies it is difficult to be forced to carry on with life as you knew it.  Nothing can ever be the same.  Whether your loved one had a will or not Mr. Roberts can lead you step by step with the proper procedures to handle estate matters skillfully in accordance with Alabama law.  Mr. Roberts knows these times are extremely difficult which must be treated with the utmost compassion and respect.

Real Estate Law

Your real estate transaction may be the biggest financial decision of your life.  The law office of James V. Roberts, PC represents individuals and businesses in all proceedings and transactions that deal with real property - land and the structures attached to it - including purchases and sales, contracts, mortgages and foreclosures, leases, options to purchase, quiet title actions, boundary or lot line disputes, construction defects, closings and management.

Guardianships/Conservatorships

A conservator is a person who is appointed by the Probate Court to manage and protect the property of a minor or incapacitated adult.  An incapacitated person is a person who is unable to manage property and business affairs due to mental illness, infirmities accompanying advanced age, chronic use of drugs, confinement, and many other instances.

A guardian is a person who looks after the personal care of a minor child or incapacitated person and their welfare, while a conservator looks after the monies and property.

The legal complexity of guardianships and conservatorships should be left to an experienced attorney who is familiar with the laws and requirements of our local probate courts.

Divorce/Custody

Sometimes good people suffer bad relationships.  When it happens to you, you want an experienced attorney on your side, whether you’re the plaintiff or the defendant.  You want to make sure your rights and property are protected, that there is a fair distribution of assets and liabilities, and that the interests of minor children, including plans for college, are resolved at one time.

Custody of your children is always an issue.  However, custody issues arise not only in divorces.  You may need to take custody of a child who has lost his or her parents, or a child who is being mistreated or neglected.

Mr. Roberts has experience in these areas and know that clients must have access to all necessary information before educated decisions can be made.
